Former President Trump Seeks Top Court Approval for State Guard Forces in the State of Illinois
On Friday, the government petitioned urgently to the federal top court, seeking clearance to deploy military reserve troops to Illinois.
This action is part of a wider push to widen the homefront role of the armed forces in a number of cities run by Democrats.
Court Fight Over Military Presence
In an immediate request, the federal legal authorities pressed the bench to overturn a lower court ruling that had stopped the sending of hundreds of military reserve members to the greater Chicago.
The presiding judge had raised doubts about the government's explanation for deploying forces, doubting its explanation in light of the situation on the ground.
A higher court supported the initial ruling on the previous day, leaving the deployment on pause while the judicial dispute proceeds.
Government's Arguments
The solicitor general, representing the government, wrote in the new filing that government officers have frequently been “menaced and targeted” in Chicago and the suburb of Broadview.
This site is home to an ICE detention facility.
The former president has earlier deployed national guard units to the Windy City and Portland, Oregon, following earlier activations to LA, the city of Memphis, and Washington DC.
The president has stated that armed forces involvement is needed to curb unrest and bolster deportation efforts.
Partisan Opposition
Elected Democrats have vehemently criticized the decision, arguing that the White House's statements are inflated and politically motivated.
They accuse the administration of misusing his authority to target political rivals.
The judiciary have also raised questions about the administration’s depiction of the situation.
Regional authorities state that demonstrations over deportation policies have been primarily modest and calm, contradicting the former president's portrayal of “combat area” conditions.
Legal Basis
At the heart of the legal battle is the administration's application of a federal statute authorizing the commander-in-chief to take control of the state guard only in situations of rebellion or when “unable with the standard military to enforce the laws of the United States”.
The administration maintains that the troops are required to defend federal property and agents from protesters.

Previously, the White House federalized several hundred members of the state guard of Illinois and ordered more Texas national guard personnel into the region.
As local leaders denounced the move, the former president escalated his rhetoric, urging the apprehension of the mayor of Chicago and the Illinois governor, both Democrats, charging them of failing to secure immigration officers.
Illinois and the city of Chicago together took legal action against the government to halt the deployment.
On October 9, Judge April Perry, a Biden appointee, handed down a preliminary order preventing the command.
